Welcome to Pawtica! The terms “we”, “our” and “us” refer to Pawtica. Pawtica operates this store and this website, including all information, content, features, tools, products and related services, in order to provide you, as a customer, with a personalized shopping experience (hereinafter the “Services”). Pawtica is a store powered by Shopify, which allows us to provide the Services to you.

The Terms and Conditions of Use below, along with all related policies (the “Terms of Service” or “Terms”), describe your rights and responsibilities when using the Services.

Please read these Terms of Service carefully, as they contain important information about your legal rights and cover areas such as disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and by our Privacy Policy [LINK]. If you do not agree to these Terms or this Privacy Policy, you must not use or access our Services.

SECTION 1 – ACCESS & ACCOUNT

By accepting these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you give us your consent to allow any minor in your care to use the Services on devices that you own, purchase, or manage.
To use the Services, including accessing or browsing our online stores or purchasing any products or services we offer, you may be asked to provide certain information, such as your email address and billing, payment, and shipping details. You represent and warrant that all information you provide in our stores is accurate, up-to-date, and complete, and that you have all necessary rights to provide such information.
You are solely responsible for maintaining the security of your account credentials and all activities that occur under your account. You are not permitted to transfer, sell, assign, or license your account to another person.

SECTION 2 – OUR PRODUCTS

We have worked to provide an accurate representation of our products and services in our online stores. However, please note that product colors or appearance may differ from how they appear on your screen due to the type of device you use to access the store and your device settings and configuration.
We do not guarantee that the appearance or quality of the products or services you purchase will meet your expectations or match what is described or shown in our online stores.
All product descriptions are subject to change at any time without notice, at our sole discretion. We reserve the right to remove any product at any time and may limit quantities of any product offered to any person, geographic region, or jurisdiction, on a case-by-case basis. For personalized items (such as custom pet photo pillowcases), the final result depends in part on the quality of the photo submitted by the customer. We are not responsible for results caused by low-resolution, blurry, or poorly cropped images.

SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase. Pawtica reserves the right to accept or decline your order for any reason, at its discretion. Your order is not accepted until Pawtica confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting it, as Pawtica may not be able to accommodate cancellation requests once an order is accepted. If we do not accept, modify, or cancel an order, we will attempt to notify you using the email address, billing address, and/or phone number provided at checkout.
Your purchases may be returned or exchanged only in accordance with our Refund Policy [LINK].
You represent and warrant that your purchases are for your personal or household use and not for commercial resale or export. For custom or made-to-order items, cancellation requests must be submitted within 24 hours of placing your order. We cannot guarantee cancellations after production has begun.

SECTION 4 – PRICES & BILLING

Prices, discounts, and promotions may change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be listed in your order confirmation email. Unless otherwise stated, prices shown do not include taxes, shipping and handling fees, or customs or import fees.
Prices displayed in our online stores may differ from those offered in physical stores or in online stores operated by third parties. From time to time, we may offer promotions on the Services that may affect pricing and are governed by separate terms. In case of conflict, promotion terms prevail.
You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made in our stores. You agree to promptly update your account information, including your email address and credit card details, to complete your transactions and contact you if necessary.
You represent and warrant that: (i) the credit card information you provide is true, correct, and complete; (ii) you are authorized to use the card; (iii) charges incurred will be honored by your credit card issuer; and (iv) you will pay all charges at the prices in effect, including shipping, handling, and any applicable taxes.

SECTION 5 – SHIPPING & DELIVERY

We are not responsible for shipping and delivery delays. All shipping times are estimates and not guaranteed. We are not liable for delays caused by carriers, customs processing, or events beyond our control. Once we transfer products to the carrier, ownership and risk of loss transfer to you. For custom or made-to-order items, production and shipping timelines are estimates only. Personalized pet photo pillowcases are produced by a third-party print-on-demand partner and typically ship within 5 to 15 business days after order confirmation.

SECTION 6 – INTELLECTUAL PROPERTY

Our Services, including but not limited to all trademarks, trade names, text, displays, images, graphics, product reviews, videos, and audio, and their design, selection, and arrangement, are the property of Pawtica, its affiliates, or its licensors and are protected by U.S. and international intellectual property laws.
These Terms allow you to use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works, display, perform, republish, download, store, or transmit the materials without our prior written consent.
All Pawtica names, logos, product and service names, designs and slogans are trademarks of Pawtica or its affiliates/licensors. You may not use them without written authorization. Shopify’s names and trademarks belong to Shopify. All other names and marks belong to their respective owners.

SECTION 7 – OPTIONAL TOOLS

You may have access to third-party tools we do not monitor and over which we have no control.
You acknowledge that we provide access to these tools “as is” and “as available” without warranties or endorsement. We are not liable for your use of optional third-party tools.
Use of such tools is entirely at your own risk, and you must ensure you are familiar with and approve the terms provided by the relevant third-party provider.
We may introduce new features or tools later, which will also be subject to these Terms.

SECTION 8 – THIRD-PARTY LINKS

The Services may contain third-party materials and links to third-party websites. We are not responsible for reviewing or evaluating third-party content and assume no liability for your choice to access such content.
We are not liable for harm or damages related to your use of third-party sites, products, or services. Review third-party policies carefully before engaging in any transaction. Complaints or concerns must be directed to the relevant third party.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Pawtica is powered by Shopify. However, all sales are directly between you and Pawtica. By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and Pawtica. You expressly release Shopify and its affiliates from any claims or liability arising from your transactions with Pawtica.

SECTION 10 – PRIVACY POLICY

All personal information collected through the Services is subject to our Privacy Policy [LINK], and some information may also be subject to Shopify’s Privacy Policy. By using the Services, you acknowledge you have read these policies.
Because the Services are hosted by Shopify, Shopify collects and processes information to provide and improve the Services. Your information may be shared with Shopify and other third-party providers located outside your country. Review our Privacy Policy [LINK] for details.

SECTION 11 – FEEDBACK

If you submit or transmit ideas, suggestions, feedback, reviews, proposals, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback for any purpose, including commercial use.
You represent that you hold all rights to the Feedback and that it complies with these Terms. We have no obligation to keep Feedback confidential, provide compensation, or respond.
We may remove Feedback we find inappropriate or that violates intellectual property laws or these Terms.
You agree your Feedback will not violate any third-party rights or contain unlawful, abusive, defamatory, or harmful content. You are solely responsible for your Feedback.

Information on the Services may contain errors or omissions, including product descriptions, pricing, promotions, shipping fees, and availability. We reserve the right to correct errors or update information or cancel orders at any time without notice, including after an order is submitted.

You may use the Services only for lawful purposes. You may not use the Services to:
(a) violate laws; (b) infringe intellectual property rights; (c) harass, defraud, or harm others; (d) submit false information; (e) transmit malware; (f) send spam; (g) impersonate others; or (h) interfere with security features.

We may terminate this agreement or your access to the Services at any time without notice. You remain responsible for all charges incurred before termination.
Certain sections survive termination, including Intellectual Property, Feedback, Disclaimer, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, and Privacy Policy.

Unless expressly stated otherwise, the Services and all products are provided “as is” and “as available” without warranties of any kind.

To the maximum extent allowed by law, Pawtica and Shopify and their affiliates are not liable for direct, indirect, incidental, punitive, special, or consequential damages, including loss of profits, data, or savings, arising from your use of the Services or products, even if advised of the possibility.

SECTION 17 – INDEMNIFICATION

You agree to indemnify and hold harmless Pawtica, Shopify, and affiliates from claims arising from your breach of these Terms or your use of the Services. We may control the defense at your expense, and you must cooperate.

SECTION 18 – SEVERABILITY

If a provision is found unenforceable, it will not affect the validity of remaining provisions.

SECTION 19 – WAIVER & ENTIRE AGREEMENT

Failure to enforce a right does not constitute waiver. These Terms constitute the entire agreement between you and us and supersede prior agreements.

SECTION 20 – ASSIGNMENT

You may not assign these Terms without our written consent. We may assign them without notice.

SECTION 21 – GOVERNING LAW

These Terms are governed by the laws of the Province of Quebec and applicable federal laws of Canada. You and Pawtica agree to the jurisdiction of these courts.

SECTION 22 – HEADINGS

Headings are for convenience only and do not affect interpretation.

SECTION 23 – AMENDMENTS

You may review the most current version of the Terms at any time. We may update these Terms at our discretion. Continued use of the Services after updates constitutes acceptance.
